Thanks for your replies. Couldn't post earlier as I've been a bit off it sorry., and got a sustained headache.

I didn't go today , but my siblings went, and regarding. Top up fees, its £20 a piece from them, tops. They cant (wont?) pay any more, so I've got to pay £100 pe month, and the rest (£60) will be paid @£20 a piece from my 3 family members.

Ill have a look at the other stuff over the weekend BB as very tired now. Goodnight.

PS: my siblings seem happy to tell me they're paying £20 per month, so - sarcastically (trust me, its not me - REALLY) i text my siblings to ask them if my brother is worth just 71 pence a day to them? (That's £20 per month).

Hello all again sorry to bother you all.

Ive just been on the phone to the DWP regarding My brothers mobility component which it says on the financial assessment form :

However, the lady on the phone after nearly 1 hour of being transferred from one person to another told me:

""""" because your brother is receiving NURSING care, we CANT pay his mobility allowence of £58.00 per week """"

If this is true, I'm going to be in serious financial difficulties, along with paying most of my family's top up fees. I'm losing serious amounts of money each month ( "in-comings versus outgoings") and I'm only on ESA myself each week. What do i do ? Surely they dont need his mobility as well as the top up fees etc? That would mean his ESA (£100.65, PIP daily living amount £83.10, Plus Mobility amount £58.00 plus top up fees £40 per week = £281.75 per week =£1,127 per month. ????

It says on the assessment form "agreement to pay:

Gross care home fees: £563.04 per week
Less Derbyshire County council : £523.04 per week
Thirds party contribution: £40.00 per week.

You should not be paying ANY top up fees, for a start!

Well, just rang the nursing home and i asked her if that the top up fee should be optional (according to the advisors here on carers.uk) but she told me that homes' charge various amounts, and their amount is £160.00 pr month. Plus this £58.00 mobility is another blow, as i thought it would still be paid in my account as it says on the assessment form that Mobility is diregarded when assessing income. That probably means its still got to be paid to the home via the council though, and this "disregard" was for my finances NOT the amount the home requires for his NURSING care. ?

My brother is partially mobile, he can walk about, but needs wheelchair because of his epilepsy. He's not bed bound.

If so , there well may be differences in benefits / allowances under UC as are being reported elsewhere.
You need to talk to Social Services NOT the home, about the fees being charged. It is unlawful to use clients money to pay top ups unless for a better room or extra optional services, so you should not under any circumstances use your brother's benefits for basic charges. The best thing to do is email our CUK helpline for the very best, free, advice about top ups or mobility benefits, before doing anything more.
