That in future, private care companies who fail in their duties and carees die because of neglect will at last be forced to be held responsible?

Also, will this have any knock on effect on carers who employ people on direct payments?
You'd need to ask a "legal eagle," Mairie, to answer this one satisfactorily, but it has always been possible to prosecute smaller employers reasonably effectively. Larger firms - which have been responsible for some of the larger disasters (the article mentions the Herald of Free Enterprise, which sank at Zeebrugge) and yet those who might have been seen to be corporately responsible walked away scot free.

Smaller firms and individuals are far more easily prosecuted because there are fewer layers of management - it's easier to point the finger of blame.
Thats why no solicitor will accept any negligence case occuring from council run care homes.
Could this ruling rectify this?
