Well hello there. - Page 2 - Carers UK Forum

Well hello there.

Socialise and chat about other areas of your life
we now have a direct payment where we employ family to look after my wife

Paul ... care to expand on that ... there are problems :

https://www.carersuk.org/forum/support- ... 20payments

If employing family members under all the terms and conditions of Employment Law , not a problem.
under present rules with our council and Direct payments you can employ a family member providing they don't live in the same household, however in exceptional circumstances it can be possible employ a family member in the same household but this would have to be agreed with your Adult Social Care team.
Paul
Thanks Paul.

So , said family member is an employee ... enjoying ALL the benefits of Employment Law ... tea breaks / pension / holiday
and sickness pay / Health & Safety protection / union representation / working time directives etc. etc ... good to see ... ?

( I assume the employer must be the caree ??? )

Same family member does not claim Carers Allowance , possibly other benefits as would other workers ?

As other readers will see , employing a family member under the same roof ... how can one police it ??

however in exceptional circumstances it can be possible employ a family member in the same household but this would have to be agreed with your Adult Social Care team.

" Exception circumstances " ... discussed early on in that main DIRECT PAYMENTS thread.

Whatever they are , clashes head on with Employment Law.

Back to that John McDermott case again ... Employment Law won by a knockout.

As for Paul's local LA , time for them to ponder on that one ???
well it works well for my family situation and all carers involved whether they be family or not, it gives my wife the full time care she needs, it gives her as much independence as possible with people she knows best rather than strangers, how dare you use my post in this way Chris, I hope your intention wasn't to upset me as I've been a carer for over 30 years, all our carers are part time and are self employed.
Not at all , Paul.

Employing family members to care comes with those benefits ... a family / kinship carer receives none of them.

That's the context I was using ... as an example ... the change from a carer to that of an employee ... within the Direct Payments ambit.

Part of the main DIRECT PAYMENTS makes a case for all family / kinship carers to be employed ... thus enabling all to have the advantages
of Employment Law ... just imagine the mayhem that would cause IF your caree became your boss ???

It's the mechanics of Direct Payments that cause concern ... no family / kinship carer should be put at risk by them.

Even less active now ... just a few diehards keeping the forum afloat.
And thank God for them/you.
I was absolutely desperate and the mental anguish was accelerating. I felt so alone, then found this forum.
Thankyou, that's all I can say. My situation is not even that arduous compared to many.

A crime that the Carers Trust didn't take in similar comments from their forum members before closing down their forum.

Really sorry to hear that.
One thing we have to do as carers is build up this forum and get more carers to open up about their situations and experiences...and get involved for demanding change. We need to stop accepting isolation and start supporting each other so if something is wrong we need to stand up and fight it as a large group who are all in the same boat. It's the only way things will ever change folks.
Welcome back to the forum Charm and congrats on becoming a great-grand mother! Definitely a blessing
