Hi all.
It has been a very hectic and trying few months with my wife's physical health, I'll explain more at a later date.
I need some advice on medical records as I don't think that my wife's GP is being completely honest, I have been doing some research into it and it's says that the law changed in 1998 stating that no person can obtain medical records by the GP for themselves or somebody else if they think that the person in question my cause harm on themselves with the information contained in it.
I was wondering if this ruling is exempt for carers who are looking after someone or if it applies right across the board.
I'll write a big catch up soon when I have got a spare couple of hours so much has happened.
Thanks Mark.
Hi Mark, I have Power of Attorney for mum. In connection with a dispute with the NHS about Continuing Healthcare, I made a "Subject Access Request" on her behalf to the GP, Health, and Social Services in December. Social Services didn't want to acknowledge my POA and still wanted mum's signature, which was soon arranged - she has physical, not mental problems. I haven't heard whether the other records have been provided to the solicitor yet, but neither have challenged my request. When I made an SAR to SSD concerning my son, some parts were blanked out when they were sent to me, because someone else had been at a meeting, but that person had not been asked for "permission to share" what they had said. Hope that helps. Send me a PM if you wish.
