Carers NI response to the Mental Capacity Bill

Carers NI responded to the consultation on the Mental Capacity Bill (NI).

Mental health legislation has traditionally been based on the notion of public protection from people perceived as having a ‘mental disorder’. We believe he proposed new capacity legislation represents an important cultural shift towards protecting the human rights of people whose mental capacity has been affected.

We welcome this progressive approach, but its implementation will depend on investing in the skills of professionals, service users and carers, as well as developing a comprehensive Code of Practice. We recommend that this should be made available for consultation in advance of the legislation. 

There are a number of elements in the Bill that are of particular interest to carers, particularly Lasting Powers of Attorney, and the new proposals for Direct Payments. Our response considers a number of areas within the Bill from a carer perspective.
