Sometimes it is difficult to know what to do when things go wrong in community care cases. There is no straightforward appeal procedure, but there are ways by which community care decisions can be challenged within England and Wales. The course assumes a basic knowledge of community care law. It is aimed at increasing the confidence and knowledge of advisers, lawyers and advocates in representing the interests of individual carers and disabled people. This particular course is not aimed at local authorities or health services (see in-house provision – Is it Lawful?)
AIMS
· to present the main procedures by which community care decisions are generally challenged
· to consider the advantages and disadvantages of each procedure
· to examine the best ways of remedying problems within the community care system
INCLUDES
· statutory complaints procedures
· local and NHS Ombudsman procedures
· judicial review, including identifying a potential legal challenge
· choosing the appropriate remedy
practical issues including referral: the Legal Services Commission
