Community care law has been described as a ‘hotchpotch’ of statutes. This course is a basic starting point for anyone wanting to get an overview to help make sense of this complex area of law.

 

AIMS

To provide an introductory overview of community care law (legislation, guidance and caselaw) within England and Wales as it relates to:
·        assessments,

·   the provision of community care services, and

·   charging issues

 

INCLUDES

·        an overview  of public law principles Community Care Law: Advanced

·        community care assessments under s47 NHS and Community Care Act 1990

·        eligibility and Fair Access to Care Services

·        service provision under the relevant statutes

·        charging for residential and domiciliary care

·        direct payments
